The most common immigration mistake companies make is placing a foreign national in the wrong visa category, most often a Business Visa when the work requires an Employment Visa. A Business Visa does not authorise paid employment in India. A foreign employee working under a Business Visa is in violation from their first day of work, and the consequences, including deportation, blacklisting, and potential criminal prosecution of both the individual and the employer, are not easily reversed once they are triggered.

Before any application is filed, we map each foreign employee's specific situation to the correct visa category: their nationality, the precise nature of the work they will perform, the duration of their stay, the structure of their employment including whether it is direct employment, secondment, or intra-company transfer, and their salary package. We identify the exact eligibility conditions, the documentation required, and the most efficient application route.

For companies managing multiple expatriate employees simultaneously, we conduct workforce-wide immigration compliance audits, reviewing the visa and FRRO registration status of every current foreign national employee, identifying existing gaps, and establishing a standardised process for all future international deployments. Arbitrary executive action on passports is addressed through constitutional litigation, not merely administrative correspondence.

FRRO Compliance

We provide FRRO registration and compliance management for individual foreign nationals and corporate groups, including extensions of stay, changes of visa purpose, and exit permit applications where visas have lapsed. In contested FRRO matters, we provide representation before the Bureau of Immigration.
